Gunbroker purchases can come from 2 different sources, FFL sellers and Non-FFL sellers. Most FFL sellers are up to date as to how to ship firearms and the requirements for the shipping. Most Non-FFL sellers are not. There are specific requirements for shipping firearms and especially state to state. Below are the specific requirements for shipping.
- A Non-FFL seller may not use FedEx, UPS, or USPS for shipping firearms according to those companies policies. Non-FFL sellers should use an FFL in their area to ship the firearm for them. Shipping it without declairing it as a firearm could possibly result in having the package seized if it should happen to break open and the buyer would lose the firearm as they will have it destroyed.
- If Non-FFL sellers decide not to use an FFL to ship, then the seller MUST include a photocopy of their state Driver’s License or State ID in the shipment for the receiving FFL to be able to enter it into their Bound Book. If they do not their is no way for the FFL to recieve the package and therefore the firearm cannot be transfered to the buyer.
- Non-FFL sellers MUST ship the package using their shippers “Adult Signature Required” feature that all shipping companies offer. This is so when the package arrives at its destination, a person over the age of 21 years old has to sign for the package. If it is not shipped this way the shipper will just drop it at the front door and it could possible be snatched by “Porch Pirates”. This could make the seller liable for any illegal use of the firearm as they are the last known owner of said firearm.
Failure of the Non-FFL Seller to follow the above proper shipping requirements could result in Oberon Arms refusing to receive the package and/or possibly returning it to the seller. We are required by Federal Law to maintain proper “chain of ownership” in our records. It is suggested that if you purchase a firearm on Gunbrioker that you pass these requirements on to the seller if they are a Non-FFL seller.
